Federal High Court Orders APC To Recognise Victor Giadom As Acting National Chairman OF The Party.
A Federal High Court in Abuja has ordered the All Progressives Congress APC to recognise Victor Giadom as the national chairman of the party.
The High Court order issued on Thursday June 18, 2020, restrained the party from blocking Giadom from performing his duties as the acting chairman.
Giadom had declared himself the acting national chairman of the APC following the vacuum created by the Appeal court affirmation of the suspension of Adams Oshiomole.
The Deputy National Secretary said he was empowered by court to pilot the affairs of the party.
The order which affirms an earlier order in march comes a day after the National Working Committee of the APC directed Abiola Ajimobi to act

Suspended National chairman of the All Progressives Congress Adams Oshiomole says he will explore legal means as next line of action.
Speaking on Channels TV Programme, Politics Today, Oshiomole said he was reflecting and consulting with his lawyers on the way forward.
He said’ l think there are people who are determined to hide behind this crisis to perpetuate their own agenda. For me, the business of APC will be done as a member.
Oshiomole a former governor of Edo state was suspended on Tuesday following Appellant Court’s affirmation of his suspension as National Chairman of the Party and member by an Abuja Court in March 2020
The Court of Appeal also upheld his suspension as a member of the APC.
The APC NWC appears polarised as two sides lay claim to the Acting capacity.
The Abiola Ajimobi faction say they are constitutionally placed to fill the voided Office of the national chairman while the faction loyal to Victor Giadom argued that a court order empowered Mr Giadom to act as chairman.
Victor Giadom who is the Deputy National Secretary had addressed a news conference where he declared himself the Acting Chairman based on a court order empowering him to do so.
He announced the cancellation of the Party screening which disqualified Governor Godwin Obaseki of Edo State.
With the emerging scenario at the APC national headquarters it is not clear whether the party will go ahead with its primary on June 22 as INEC has warned that the dates it has set aside for submission of names and conclusion of primaries remain sacrosanct.

Interestingly there is another twist by a Court process which gives right to statutory members the right to constitute a caretaker committee with the claimant as chairman
The Court noted that the National Working Commitee of the APC,”s decision to appoint a caretaker committee was not ultra vires the Constitution of the party but the exclusion of statutory members is unconstitutional,null and void.
The plaintiff had prayed a Port Harcourt High Court to set aside the appointment of a caretaker committee in Rivers State by the National Working Commitee of the APC.because of the exclusion.
In the face of a lacuna by the ouster of the voided committee, the claimant sought the Court to incorporate him into a fresh caretaker committee as chairman and all statutory members of the State Executive committee as members
Some party faithful dismissed the Court action as another evil that has befallen the party while others cautioned differently describing the court judgment as a new wave of hope,a New direction which would make the party come out stronger.

Prior to her nomination for substantive president of the Appeal court, Justice Dongban has been acting in that capacity following the retirement of Justice Bulkachuwa who was the last occupant of that office.
The delay in her nomination for the substantive post had generated mixed reactions from the public. While some Nigerians argued that the president may refuse to appoint her because she is a Christian from the North, others feel she may not be easy to influence.
Her nomination by Mr President has discarded serial speculations in the past.
