A High Court sitting in Jos, the Plateau State Capital,has reserved ruling on the case filed by Obadiah Mailafia, former Deputy Governor of Central Bank of Nigeria challenging the invitation by the police on a matter being investigated by a sister Organisation the Department of State Security,DSS ,as well as enforcement of his fundamental rights to personal liberty and fair hearing.
Justice Arum Ashoms has fixed September 29 for the ruling of the application to determine the motion on notice filed by the applicants as well as the counter affidavit instituted by the defence.
Mailfia had in an interview on a radio station disclosed amongst others that a northern governor, was a chief sponsor of Boko Haram. a disclosure viewed as having the capability of causing
further security breaches and division in the country.
The DSS had in the wake of the statement which went viral invited the former CBN deputy governor for Investigation,an invitation he honoured. After that, the police invited Mailafia to appear at the Force Criminal Investigation Department in Abuja for Investigation on same matter, an action perceived by his legal team as illegal since he is being investigated by the DSS leading the team to file an application for enforcement of his fundamental rights to personal liberty .
The Police in a counter affidavit,stated that the applicant deliberately filed the action to stop them from performing their statutory duty asserting that he has no right to choose which agency’s invitation he will honour for Investigation.
The force on that prenise, asked the court to dismiss the application describing it as abuse of court process.
The DSS has again invited Mailafia to appear at its office in Jos on Monday September,14 an invitation which is seen as becoming regular in attempt to unavel the authenticity of Mailafia’s comments on radio.
