A High Court in Aba,Abia State has given interim injunction restraining the Abia State Independent Election Commission (ABSIEC) from conducting the local government election in the state scheduled for December 18, pending the determination of the motion on notice.
The All Progressives Congress (APC) in the state had sued (ABSIEC) over issues involving the infringement of the rights of its candidates and prayed the court to stop the commission from taking further actions that would limit the chances of winning in the election.
, Justice Agwu Umah Kalu, upon reading the exparte motion filed by the claimant ordered interim injunction restraining ABSIEC from taking any other step in conducting the election pending the determination of the motion on notice.
The Judge also restrained the defendant from demanding from the candidates of the applicant any fee for the purpose of the election
.In addition , the defendant was restrained from refusing to issue the claimant with relevant forms for the election and from excluding candidates of the applicants from participatiing in the election on the non payment of fees imposed by the defendant or any other ground not supported by law pending the determination of the motion.
