Appeal Court sets aside order restraining Rivers APC membership registration, revalidation
The Court of Appeal sitting in Port Harcourt has vacated the order of Interim injunction against the conduct of membership registration and revalidation excersise of the Rivers State Chapter of the All Progressives Congress APC.
Some members of the party loyal to former member of the National Assembly, Senator Magnus Abe had dragged the party to court in January to restrain it from carrying out the registration/revalidation exercise in the state until a state congress is held.
Their prayers were held as Justice Okogbule Gbasam granted the order halting the take off of the exercise.
However,a three – man panel of judges led by Justice H.S Tsamimani , on Monday, faulted the extension of the exercise by the high court and therefore vacated the order.
The court also struck out APC appeal against Sunday Hopkins and four others and an appeal by APC against Emma Deeya and four others for lack of jurisdiction.
One of the counsels to APC,Chimenem Jerome expressed satisfaction with the court’s decision saying”With the outcome of the court today, the party can now going ahead to conduct the membership registration and revalidation exercise, adding that they would study the judgement to know the next line of action.”
But counsel for the defendants, Luke Patrick said they are prepared to return to the high court to continue with the case
