Embattled Governor of Ebonyi State, David Nweze Umahi has filed an appeal at the Court of Appeal , Abuja.
In the Notice of Appeal, the appellants,Dave Umahi and his Deputy” being dissatisfied with the judgement of the Federal Higher Court ( Holden at Abuja), delivered on the 8th day of March,2022, by Hon. Justice Ekwo in Suit No FHC/ ABJ/ C$/ 920/2022 do hereby appeal to the Court of Appeal upon the Grounds that the trial court erred in law and misdirected itself when it held” I have not seen any authority which propounds that where a Governor or Deputy Governor defects his political party on which platform he was elected into office,he cannot be sued by that political party to reclaim it’s mandate . Section 308 of the 1999 Constitution did not envisage such a situation” the appeal states
Citing further errors in law in which the trial court overruled the decision of High Court of Ebonyi State and that of Zamfara State, Umahi is seeking an order of the Appeal Court to hear the appeal and set aside the judgement of the trial court delivered in 8 th March,2022 and all orders made therein by the trial court.
Respondents are : The People’s Democratic Party PDP, The Independent National Electoral Commission INEC and the All Progressives Congress APC.
