Ahead of Inauguration of Senator Bola Ahmed Tinubu as the President and Commander,- Chief, some residents of the Federal Capital Territory (FCT) are seeking a court order to stop the May 29 inauguration.
The residents who filed the suit before a Federal High Court in Abuja are praying the court not to swear in any of the candidates of the February 25 Presidential election as president or Vice President.
Represented by Anyaegbunam Ubaka Okoye, David Aondover Adzer, Jeffrey Oheobeh Ucheh, Osang Paul and Chibuke Nwachukwu, the complainants are seeking a court order restraining the Chief Justice of Nigeria and any judicial officer and/or any authority or persons from swearing in any candidate in the February 25 presidential election as president or vice president
According to them, their request is anchored on the need to judicially determine with finality in accordance with the provisions of Section 134(2)(b) of the Nigerian Constitution that any candidate so declared fulfilled the requirements of the constitution.
They also want an order of the court “setting aside or suspending any declaration and/or issuance of a certificate of return to any candidate in the February 25th presidential election in the country or having been elected save and except it is judicially determined with finality that such candidate fulfilled the conditions stated at Section 134(2)(b) of the Constitution.”
The implication of this is that the litigants wants Buhari to remain in power until the whole issue of the election is sorted out.
Given the maximum of win in votes declared, the Independent National Electoral Commission (INEC) had declared Tinubu of the All Progressives Congress (APC) winner of the February 25 presidential poll
Tinubu beat his closest rival,Atiku Abubakar of the Peoples Democratic Party (PDP) and Peter Obi of Labour Party, who placed second and third respectively.
Atiku and Obi have since taken their grievances to the court of law to challenge the outcome of the election.
