The Court of Appeal sitting in Abuja has nullified the July 24 judgment by the National and State Houses of Assembly Election Tribunal in Asaba, declaring Ndudi Elumelu of the Peoples Democratic Party (PDP) as winner of the last election for Aniocha/Oshimili Federal Constituency of Delta State.
The Appeal Court, in two judgments on Thursday, declared Ngozi Okolie of the Labour Party (LP) as the authentic winner of the February 25th election.
The tribunal had sacked Okolie the member – elect declaring that he was not a member of the Labour party LP during the party primary.
The Appeal Court however overruled the election petitions tribunal for nullifying the election of Okolie who it said ,was duly nominated and sponsored by his party in agreement with the Labour party LP lawyer, Mahmud Magaji( SAN ) and that he resigned as SSA to the Delta State Government as required by law.
