Presidential candidate of the Peoples Democratic Party PDP in the February 25 presidential election,Atiku Abubakar has lost an appeal to nullify the election of Bola Tinubu of the All Progressives Congress APC in seven areas including testimonies of witnesses,iReV, 25% total vote cast for FCT and forgery.
The Supreme Court held that the Presidential Election Petition Tribunal cannot be faulted for dismissing the testimonies of witnesses of the 2023 presidential candidate of the Peoples Democratic Party (PDP), Atiku Abubakar.
The Tribunal had dismissed the testimonies of his witnesses as ” hearsay ‘
However,Atiku and the PDP appealed the ruling of the Tribunal which dismissed their petition seeking to nullify the election of President Bola Tinubu.
But the presiding justice of the panel, John Okoro held that the position of the lower court describing the testimonies as hearsay “cannot be faulted”.
Justice Okoro said the witnesses could only give evidence in their own polling units where they were present adding “What they were told is hearsay evidence”
“From the evidence on record, it is indisputable that the witnesses were not present in all the polling units and that their testimonies about others are merely hearsay.”
The court also dismissed the fresh evidence from the Chicago State University CSU for lack of jurisdiction describing it as a “friendly joke”
