
The Court of Appeal, Abuja, on Wednesday granted the Independent National Electoral Commission INEC request to reconfigure the BVAS for the gubernatorial election slated for March 11 nationwide.
The Labour Party’s Presidential candidate, Mr Peter Gregory Obi has filed an application seeking to stop the Independent National Electoral Commission, INEC, from reconfiguring the BVAS equipment used for the conduct of the February 25 Presidential election.
The Court held that granting Obi and his party’s request would jeopardize INEC in the conduct of the March 11 governorship and State Houses of Assembly elections.
The Court agreed with INEC that information on accreditation contained in the BVAS devices had been uploaded into its back up server and could be accessed at any time.
The court further also agreed with INEC that all averments in the counter affidavit of the Electoral body were not challenged and therefore, granted the electoral umpire the request to reconfigure the BVAS for the next election.
Obi had challenged the decision of INEC to reconfigure the BVAS at the Court of Appeal arguing that it was to ensure that evidential materials were not tampered with.
