The Court of Appeal in Benin City on Monday,set aside the judgement of the High Court which nullified the candidacy of Audu Ganiyu the Deputy Governorship Candidate of the All Progressives Congress APC and governoship candidate, Pastor Osagie Ize- Iyamu in last September governoship election in Edo State.
The high court had on a judgement delivered on January 6, 2021, held that Ganiyu submitted false information in his form ec9 to the Independent National Electoral Commission INEC
But the Court of Appeal in Monday’s ruling on three separate appeals filed by Iyamu, Ganiyu and the APC, held that the case at the high court was statute barred as it was filed out of time.
On the issue of forgery, the court vacated the judgement of the high court on the basis that it lacked merit adding that no proof was made to establish the claims.
